Terms & Conditions of "Quick Heal 10% Discount Renewal Offer" for Renewal 2022

IMPORTANT NOTE:

Please read the following terms & conditions carefully before accepting the "Quick Heal 10% Discount Renewal Offer" issued by Quick Heal Technologies Limited having its registered office at Marvel Edge, 7th Floor, Office No.7010 C & D, Viman Nagar, Pune – 411 014, Maharashtra, India. By participating in this Offer you agree to be bound by the Terms & Conditions mentioned in this Offer.

Definitions

"Activation" means renewal, cross renewal or new product key as renewal key of Quick Heal Offer Product(s) within Offer Period.

"Assured Benefit" means 10% discount on renewal of the Offer Product(s) on MRP.

"Batch Code" means an alphanumeric number displayed on the product box generally found along with the product key, provided by Quick Heal for Quick Heal's Products.

"End User" means such users who hold Indian citizenship and reside in India, who are competent to contract and who have renewed the Offer Products only through online mode and solely for his/her individual use and not for resale, distribution or any other commercial purpose.

"Offer Product(s)"means and includes the following Products which function on Windows Operating system:

• Quick Heal Total Security (1 user pack)
• Quick Heal Internet Security (1 user pack)
• Quick Heal Anti-Virus Pro (1 user pack)
• Quick Heal Total Security for Mac (1 user pack)
• Quick Heal Internet Security Essentials (1 user pack)

"Offer Period" means the period commencing from 00.00 hours IST of 1st December, 2022 to 23:59 hours IST of 31st January, 2023.

"Online Renewal" means the renewal of the Offer Product(s) from https://www.quickheal.co.in by the end user residing in India during the Offer Period and selecting the option of physical medium on https://www.quickheal.co.in at the time of such renewal. This offer is applicable only to Products Renewed from https://www.quickheal.co.in.

"Product Key" means the alpha-numeric number key provided by Quick Heal for Offer Products.

"Renewal" means continuation of Offer Product(s) after expiry of initial activation by End User.

"The Link" means https://www.quickheal.co.in

"Working days" means Monday to Sunday IST 9.00 a.m. to IST 7.00 p.m.

Applicability

This Offer is applicable only on renewal of expired licenses.

This Offer is applicable ONLY to "Offer Product(s)" as defined hereinabove.

This Offer is applicable for online renewal of the Offer Products made during the Offer Period.

This Offer is applicable for the Regular and Standard Edition of the Offer Product(s).

This Offer is applicable ONLY within the geographical territories of India.

The End User has to renew Offer Product(s) within the geographical territories of India to be eligible to participate in this Offer. Quick Heal shall not entertain any claim from End User who renewed Offer Product(s) outside the geographical territories of India.

This Offer SHALL NOT be applicable to:

• Products including Offer Product(s) Renewed with any discounts on pricing already provided by the Company.
• Products provided for promotional purposes.
• Products keys issued for trial purposes.

Offer is applicable only on renewals.

This Offer SHALL NOT be applicable to the products listed below:

• Quick Heal Total Security for Android
• Quick Heal's Admin Console
• Quick Heal's Anti-Virus for Linux
• Quick Heal's Anti-Virus for Novell
• Quick Heal Terminator
• Quick Heal Mail Protection for Linux
• Quick Heal Mail Protection for Windows
• Quick Heal Exchange Protection
• Quick Heal PC Tuner
• Quick Heal End Point Security
• Quick Heal Total Security for Mac

This Offer will not be applicable with respect to the Offer Product(s) renewed under certain cases including academic cases as decided by Quick Heal, in its sole discretion.

This Offer shall not be applicable to the products/licenses issued for trial purpose, Packs for bundling, 'OEM packs' of Quick Heal.

This Offer shall not be applicable to any Complimentary packs provided by Quick Heal.

This Offer cannot/shall not be combined with any other Offer.

Quick Heal shall not entertain any correspondence or claim from End User who Renewed / has Renewed Offer Product(s) without complying or by violating any of the terms and conditions of the Offer.

Renewal

The participation in this Offer is completely voluntary and it is understood that the participation by the End User shall be deemed to have been made on a voluntary basis. This Offer is applicable only for End Users who renew the Offer product(s) online through the Link. The terms of End User License Agreement (EULA) appended into the Offer Product shall be binding on the End User.

It shall be mandatory for the End User to renew the Offer Product (s) in the geographical territories of India.

It shall be mandatory for the End User to submit accurate, complete and true information including Offer Product(s) Key as well as Offer Product(s) Batch code at the time of renewal. End User shall be deemed to be disqualified from participating in the Offer, in case of any misrepresentation / concealment of information / discrepancy / non-compliance in whatever form as found by Quick Heal.

The Assured Benefit under this Offer cannot be exchanged for other benefits (in whatever form) not mentioned expressly herein including but not be limited to any monetary or cash benefit.

The End User, in order to avail the discount offered herein, shall renew the Product online at www.quickheal.co.in and use the coupon code “RENEW20”.

THE NAME OF THE END USER AND OTHER PERSONAL DETAILS LIKE ADDRESS, PHONE NUMBER, EMAIL ID ETC.) OF THE END USER WHILE RENEWING THE OFFER PRODUCT(S) MENTIONED ON THE INVOICE MUST BE IDENTICAL TO THE NAME OF THE END USER AND OTHER PERSONAL DETAILS TO BE MENTIONED AT THE TIME OF RENEWAL OF THE OFFER PRODUCT(S).

Product Key and Renewal Key

The responsibility and liability of Quick Heal towards the End User renewing Offer products shall end from the time of dispatch of the Product Key by Quick Heal to the End User. Quick Heal shall not be liable and / or responsible where in case of (I) ineligibility of the End user to participate in this Offer for whatsoever reason; (ii) loss of product key in transit, (iii) non-receipt of product key during the Offer Period, (iv) tampering of product key in transit, (v) lack of information and knowledge. Quick Heal shall not entertain any correspondences and communications in this regard.

General

In case of any ambiguity in the Offer or any communications thereto, the decisions of Quick Heal will be final, conclusive and binding in relation to the interpretation of this Offer. Quick Heal will not entertain any further correspondences in this regard.

The Assured Benefit under this Offer cannot be combined with any other Offer except as determined by Quick Heal in its sole discretion.

The Product images and Product prices displayed on the website may be used for reference ONLY. The actual Products and prices may vary due to market dynamics and change in conditions.

Quick Heal reserves the right to revoke, withdraw, discontinue, alter, amend or modify the Offer at any stage without notice and without any liability thereof to the End User or any third party.

Quick Heal does not make any commitment, express or implied, to respond to any feedback, suggestion or queries, of the end user or furnish any reasons for inclusion and/or exclusion of any particular submission of the end user at any stage of the Offer.

In no event will Quick Heal be liable for any indirect, inconsequential, special, punitive or exemplary damages arising in any form or manner whatsoever even if Quick Heal was advised of the possibility of the same. The total aggregate liability of Quick Heal for direct damages arising out of or related to this Offer shall be limited to the price of that particular Offer Product from which such claim or liability arises.

This Offer is not applicable to Quick Heal's employees and their families, Quick Heal's dealers, distributors, e-Commerce Websites, Stockiest and their employees and families.

The Terms and Conditions incorporated herein supersede any conflicting versions of the terms and conditions appearing elsewhere.

The Offer shall be void, if prohibited by law. In such an event, Quick Heal shall not be liable to provide any other Offer or benefit or any compensation in lieu thereof to the End User.

The End User shall indemnify, defend and hold harmless Quick Heal, its Affiliates, directors, officers, employees, representatives from any and all suits, actions, claims, demands, liabilities, fines or penalties including legal fees and all other direct and indirect expenses, arising during the continuance of this Offer or anytime thereafter and in any manner directly or indirectly caused, occasioned or contributed to in whole or in part, by reason of breach of the terms and conditions contained herein.

The website link provided above, or any other website of Quick Heal, or relating to this Offer, the software, marketing/promotional materials (in print, electronic, radio medium) is protected by the applicable laws of copyright, trademark, patent and other applicable laws.

All intellectual property rights including but not limited to trademarks, brand names, logos are the sole and exclusive property of Quick Heal. Nothing contained herein is intended to grant or transfer any proprietary rights to the End User in respect of the intellectual property owned by Quick Heal.

Quick Heal accepts no responsibility for late, lost, incorrectly submitted, delayed, corrupted, incomplete or misdirected submissions made by the End User whether due to theft, destruction, tampering, error, transmission interruption, communication failure, deletion or whatsoever reason.

The renewal of Offer Products provided hereunder is on “as is” basis and Quick Heal expressly disclaims all warranties of merchantability, fitness for a particular purpose or non-infringement in relation to the Offer Products.

The relationship between the Quick Heal and End User shall be on a principal to principal basis.

Quick Heal shall not be liable to fulfill its obligations in the event such performance is rendered impossible or impracticable owing to circumstances beyond its reasonable control.

This Agreement shall be governed by and construed in accordance with the laws of India. The competent courts of Pune shall have exclusive jurisdiction to try and decide upon matters related to or arising out of this Offer.
